Maryland’s SAFE Act (Statute Against Financial Exploitation) empowers older and vulnerable adults to seek justice when they fall victim to financial abuse. Enacted on October 1, 2021, the SAFE Act provides a civil cause of action for individuals aged 68 and older, as well as “susceptible adults”—those who are unable to manage daily life or protect their rights due to physical, mental, or addiction-related limitations.

Under the SAFE Act, perpetrators who exploit these individuals through deception, undue influence, or abuse of trust may be held accountable. Victims or their representatives can pursue legal action to recover misappropriated funds, with the potential for treble damages (up to three times the amount taken) and reimbursement for attorney’s fees. Importantly, the statute of limitations for filing a claim is extended to five years, recognizing the challenges in detecting and addressing such exploitation.
