Protection of an Elderly Homeowner from Financial Exploitation
January 15, 2026Byrd & Byrd successfully represented the surviving family members of a 68-year-old woman whose preventable death followed a cascade of medical failures during and after orthopedic surgery.
Our client was hospitalized after sustaining a knee injury from a fall. Despite a pre-operative evaluation documenting severe aortic stenosis—a serious and well-known cardiac condition—she was cleared for surgery. Following the procedure, her medical providers failed to appropriately monitor her oxygen levels and laboratory values. When physical therapy evaluated her the following afternoon, she was found to be drowsy, dizzy, and critically hypoxic, with oxygen saturation levels dangerously low. Although these findings were reported to hospital staff, the patient was later discovered unresponsive. A code was called, blood transfusions were given, and she subsequently passed away.
