October 3, 2013On May 2, 2008, Timothy Leahy, attorney for Byrd & Byrd, filed suit as the representative Plaintiff in a class-action lawsuit against Montgomery County for allowing ACS (a private company) to get a contingency fee for every speed camera ticket that was paid. According to statute, if Montgomery County hired a contractor to operate the speed camera system, then the contractor could not be paid a contingency fee.
Therefore, a lawsuit was filed in 2008 and over the last four years has been fought to be heard in the courts. In the week of March 19, 2012, Maryland’s Court of Appeals agreed to take the case after it had been dismissed by the Circuit Court and Court of Special Appeals.
Hopefully the Court of Appeals is going to reverse the lower courts and give Maryland citizens back their due process rights.
