After being befriended by a real estate professional and her adult son, the client was persuaded to grant them access to her finances and to transfer the deed to her home based on promises of lifetime care and the ability to remain in her residence.
When a concerned neighbor discovered that the client was living in unsafe and neglectful conditions, immediate steps were taken to secure medical care and protect her legal interests. Our attorneys were retained to investigate the circumstances surrounding the property transfer and to pursue corrective legal action.
The matter proceeded to a highly contested four-day trial, with Timothy Leahy serving as lead trial counsel and Patricia Cleary as second chair. Following the presentation of evidence and witness testimony, the court returned a verdict in favor of the estate. As a result, the property was restored to the estate, holding accountable those who abused a position of trust and preserving the client’s legacy.
